1Overview
Members own what they make, and we expect everyone to respect other people’s work and brands. If something on Palster uses your copyrighted work or your trademark without permission, tell us and we’ll act quickly. Reports are reviewed by a person.
Before you report, consider whether the use might be allowed, for example a short quote for commentary, criticism, news or parody (“fair use” or “fair dealing”), or whether you could simply ask the member to take it down.
2Reporting copyright infringement
Send your notice to our copyright agent through the contact form or by email to [email protected], or by post to Grant Networks, LLC, Attn: Copyright Agent, 24A Trolley Square, Wilmington, DE 19806, United States. Following the US Digital Millennium Copyright Act (DMCA), please include:
- Your name, postal address, phone number and email address.
- What work you believe was infringed (for example, a link to the original, or a description).
- The link to each item on Palster you want removed, specific enough for us to find it.
- This statement: “I have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.”
- This statement: “The information in this notice is accurate, and under penalty of perjury, I am the owner, or authorised to act on behalf of the owner, of an exclusive right that is allegedly infringed.”
- Your physical or electronic signature (typing your full name is fine).
When we remove content, we tell the member who posted it and send them a copy of the notice, which includes your name and the details you gave. Please don’t send false notices: you may be liable for damages if you knowingly misrepresent that something infringes.
3If your content was removed
If you believe we removed your content by mistake, or that you had the right to use it, you can send a counter-notice to the same address with:
- Your name, postal address, phone number and email address.
- The content that was removed and where it appeared on Palster.
- This statement: “Under penalty of perjury, I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.”
- A statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Palster may be found), and that you will accept service of process from the person who sent the original notice.
- Your physical or electronic signature.
We send the counter-notice to the person who reported you. Unless they tell us within 10 business days that they have started a court case to stop the infringement, we may put your content back within 10 to 14 business days.
4Repeat infringers
We close the accounts of people who repeatedly infringe others’ copyright. An account is likely to be closed after three valid notices that weren’t successfully countered, and sooner for serious cases.
5Trademarks
If an account, page, handle, listing or post uses your trademark in a way that confuses people about who is behind it, or sells counterfeit goods, report it through the contact form or [email protected]. Include your name and contact details, the trademark and where it is registered (with a registration number if you have one), the link on Palster, and how it is being misused. Using a brand’s name to talk about it, review it or resell genuine goods is generally allowed.
6Palster’s own marks
Palster, Palsenger, Palneum, Pulse, Campfire and the Palster logo are trademarks of Grant Networks, LLC. You can mention them to talk about Palster, but please don’t use them in a way that suggests we sponsor or endorse you, or in your own product’s name. For press use of our logo, write to [email protected].
